These Terms of Service (“Terms”) govern your access to and use of hoshenco.com (the “Site”) and any purchase from Hoshen (“Hoshen,” “we,” “us,” or “our”). By visiting the Site, creating an account, or placing an order, you agree to these Terms and to the policies referenced in them.

Please read these Terms carefully. If you do not agree, do not use the Site.

1. Eligibility and acceptable use

You must be legally capable of entering into a binding agreement in your jurisdiction, or use the Site with the involvement of a parent or legal guardian. You may use the Site only for lawful, personal purposes.

You must not misuse the Site; violate any law; infringe intellectual-property or privacy rights; submit false or misleading information; transmit malicious code; interfere with the Site’s security or operation; scrape or copy content without permission; or use the Site or its products for unauthorized commercial resale.

2. Shopify

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services. Your personal information is processed as described in our Privacy Policy and, where applicable, by Shopify under its consumer privacy terms.

3. Product information and natural variations

We aim to describe and display products as accurately as possible. Screen settings and photography may affect how colors appear. Measurements are approximate unless expressly stated otherwise.

Natural gemstones and pearls vary in color, shade, shape, size, texture, inclusions, markings, and luster. These natural characteristics are not defects and mean that the piece you receive may not be identical to a photograph.

Materials and finishes are stated on the relevant product page. Sterling silver and plated finishes may naturally tarnish or change over time depending on wear, skin chemistry, storage, moisture, cosmetics, and exposure to chemicals. This is not necessarily a manufacturing defect.

Any description of a gemstone’s symbolism, tradition, energy, or spiritual meaning is provided for cultural and inspirational purposes only. It is not medical, psychological, or professional advice, and our products are not intended to diagnose, treat, cure, or prevent any condition.

4. Prices and availability

Prices, promotions, product availability, and descriptions may change without notice. The price charged is the price displayed at checkout when the order is submitted, subject to correction of obvious errors.

Prices may be displayed in different currencies for convenience. Your payment provider may apply conversion rates or fees. Taxes, shipping charges, duties, and other charges are shown at checkout where applicable or are payable by the customer as explained in our Shipping Policy.

We may limit quantities, discontinue products, or restrict sales to certain customers, regions, or jurisdictions where reasonably necessary and permitted by law.

5. Orders and acceptance

Submitting an order is an offer to purchase. An automated order confirmation means we received the order; it does not necessarily mean we accepted it. We may accept an order by processing payment or dispatching the product.

We may refuse or cancel an order for reasons including product unavailability, suspected fraud, payment failure, pricing or description error, shipping restrictions, or violation of these Terms. If we cancel after payment, we will refund the amount charged for the cancelled item.

You are responsible for providing accurate billing, shipping, and contact information and for promptly updating us if it changes.

6. Payment

You authorize us and our payment providers to charge the payment method selected at checkout for the total shown. Payment information is handled by Shopify and/or third-party payment providers and may be subject to their terms.

7. Shipping and delivery

Processing times, delivery estimates, tracking, customs charges, address responsibilities, and shipping limitations are described in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates unless we expressly agree otherwise. We are not responsible for delay caused by carriers, customs, incorrect addresses, events outside our reasonable control, or other circumstances described in the Shipping Policy, except where applicable law provides otherwise.

8. Returns, refunds, and cancellations

Returns, exchanges, refunds, defects, and cancellation requests are governed by our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms removes mandatory consumer rights.

9. Jewelry care and use

Jewelry is delicate and should be handled with care. Follow any care instructions supplied with the product or shown on the Site. Keep small jewelry components away from babies and young children, as they may present a choking hazard.

You are responsible for choosing an appropriate size and for using the product safely. Stop wearing an item if it is damaged, causes irritation, or has a loose component.

10. Intellectual property

The Site and its content—including the Hoshen name and branding, logos, product designs, photographs, graphics, videos, text, and layout—are owned by or licensed to Hoshen and are protected by intellectual-property laws.

You may view and use the Site for personal shopping. No content may be copied, reproduced, modified, distributed, sold, published, or used commercially without our prior written permission, except as allowed by law.

11. Reviews, feedback, and user content

If you submit a review, photograph, comment, idea, or other content, you confirm that you have the right to provide it and that it is lawful, accurate, and does not infringe another person’s rights.

You grant Hoshen a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, translate, and display that content for operating, improving, and promoting our business, subject to applicable privacy law. We may remove content that we reasonably consider unlawful, abusive, misleading, or inappropriate.

12. Third-party services and links

The Site may include services, apps, payment methods, social-media features, or links provided by third parties. We do not control those third parties and are not responsible for their content, availability, security, or practices. Your use of a third-party service may be subject to separate terms and privacy policies.

13. Disclaimer

We aim to provide a reliable Site and quality products. To the fullest extent permitted by law, the Site is provided on an “as available” basis, and we do not guarantee that access will always be uninterrupted, secure, or error-free.

Any warranties or guarantees that cannot legally be excluded remain in full force. Nothing in these Terms excludes liability for fraud, intentional misconduct, personal injury caused by negligence, defective products where liability cannot be excluded, or any other liability that applicable law does not allow us to exclude.

14. Limitation of liability

To the fullest extent permitted by law, Hoshen will not be liable for indirect, incidental, special, or consequential loss arising from use of the Site or products. Where liability may lawfully be limited, our total liability relating to an order will not exceed the amount paid for that order.

These limitations do not apply where prohibited by applicable law and do not reduce mandatory consumer rights.

15. Events outside our control

We are not responsible for failure or delay caused by events beyond our reasonable control, including carrier or customs disruption, severe weather, fire, natural disaster, epidemic, war, terrorism, civil disorder, government action, labor dispute, widespread technology or utility failure, or significant security events. We will take reasonable steps to limit the effect on affected orders.

16. Suspension and termination

We may suspend or end access to the Site if you materially violate these Terms, misuse the Site, or create a security or legal risk. Provisions that by their nature should continue after termination will remain effective.

17. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect, and the affected provision will be interpreted as closely as legally possible to its intended purpose. A failure to enforce a provision is not a waiver of the right to enforce it later.

18. Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. This choice does not deprive a consumer of any mandatory protection available under the law of the country where the consumer resides. Courts with lawful jurisdiction may hear a dispute as provided by applicable law.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Changes apply prospectively unless law requires otherwise.
